Definitions and interpretation
Agency means Huddersfield and Holmfirth Nannies
Applicants means an individual wishing to provide Childcare Services to a prospective Employer
Childcare Services means full and/or part-time nanny services
Employer means any person contacting the Agency seeking introductions to Applicants
These Terms and Conditions shall represent a legally binding contract between Huddersfield and Holmfirth Nannies ("the Agency") and the Applicant.
The verbal or written instruction of the Agency by the applicant to submit their details to suitable, prospective employers, shall constitute acceptance of the Agency's Terms and Conditions.
Either party may terminate the Contract immediately on written notice to the other. __________________________________________________
Applicants agree to provide the agency with the following:
· Curriculum vitae
· Proof they have the right to work in the United Kingdom e.g. a valid U.K. work permit/visa if non-European.
· Confirmation of identification and address: two of the following original documents, with at least one showing a photograph and one showing an address.
- Current passport
- Current full U.K. driving licence
- Utility bill (recent)
- Bank statement (recent)
- Birth certificate
· Enhanced disclosure (DBS) check conducted within last 12 months (we can help with this)
· Details of a minimum of two references from previous employers (one of which must be the present/last employer) and/or college.
· Minimum of two years experience working in a childcare environment and/or suitable childcare qualification (original certificates required).
Applicants agree to provide information that is complete, true and accurate.
Applicant’s information will be released to employers. Under no circumstance will the agency release the applicant’s personal information to any third parties, as per our confidentiality policy.
Huddersfield and Holmfirth Nannies will not charge applicants to join our agency.
The agency and the applicant acknowledge that there is no employee/employer relationship between the applicant and the agency. The applicant does not have, nor shall have any right, power or authority to create any contract or obligation, either express or implied on behalf, in the name of, or binding upon the agency. The applicant cannot work for other clients using the agency’s name and reputation.
The agency agrees to provide honest and accurate information about an applicant to employers.
The applicant can agree to “try out” for a day with an employer, so long as the agency has been advised. The try out term will be no longer than one 8-hour day, and the client must agree to pay the applicant a full days wage at a pre-negotiated amount. While the applicant is working for the trial day, the employer will assume full responsibility for the applicant’s safety and well-being. Should the family ask the applicant to work 2 or more trial days, we will assume the applicant has been “hired” and they must alert the agency immediately.
The agency is under no obligation to find or provide a job to any applicant that has been interviewed. We are a matching service and provide no guarantee that the right job will be found.
The agency does not provide any representations or warranties to the applicants regarding any client.
Any DBS checks, First Aid training or any other requirements or expenses will be the responsibility and expense of the Applicant.
We strongly recommend the Applicant discusses wages and working conditions with the employer, and signs a Work Agreement prior to beginning work. The agency will not provide any representation or warranties of negotiating any wages, loss of wages, termination, and working conditions that result or may result in working for the employer.
The Applicant is under no legal obligation to work for a particular employer.
The applicant agrees that the agency shall not be liable to the Applicant, or to any other person, for incidental or consequential losses, damages or expenses, directly or indirectly arising from any action or failure to act by an employer.
All correspondence, both written and oral communication shall be confidential and remain the property of the Agency. Information supplied by the Agency is confidential and is accepted by the Applicant on the condition that such information will not be disclosed to third parties including through any failure to exercise all due care and diligence.
The Applicant’s obligations of confidentiality and non-use in this condition shall continue after termination of the Contract.
